Understanding New Zealand Tenancy Law: What Landlords and Tenants Need to Know
From the team at Ray White Orewa Property Management

Navigating tenancy law in New Zealand can be complex, especially with recent changes and increased responsibilities for both landlords and tenants. At Ray White Orewa, we’re committed to keeping our clients informed and protected. Whether you’re a first-time landlord or a long-term tenant, understanding your rights and responsibilities under the Residential Tenancies Act is crucial.

Recent Changes in Tenancy Law

Over the last few years, tenancy law in New Zealand has seen significant updates, most recently with the Residential Tenancies Amendment Act 2024. Here are some key changes every property owner and renter should be aware of:

  • Re-introduction of No-Cause Terminations: Landlords can now end periodic tenancies by giving 90 days noice without a valid reason.

  • Tenant’s Notice to vacate the premises: Tenant’s can give tenants 21 Days notice without reason (periodic tenancy only) if they want to vacate the property.

  • Tenancy Tribunal Attendance: The Tenancy Tribunal will now have the option to decide matters by reading submitted documents instead of having parties (landlord & tenant) attend the hearing.

  • Healthy Homes Standards Compliance: All rental properties must comply with the Healthy Homes Standards, which include rules around heating, insulation, ventilation, moisture ingress, and draught stopping. Full compliance is now mandatory for most rentals.

What This Means for Landlords

At Ray White Orewa, we understand the stress that compliance can bring. Our property management services include:

  • Ensuring your property meets all legal requirements, including Healthy Homes inspections and reporting

  • Keeping accurate records and documentation in case of tenancy disputes

  • Managing tenant communication and ensuring all legislative responsibilities are fulfilled

By partnering with us, you can enjoy peace of mind knowing your investment is protected and compliant.

What Tenants Should Know

Tenants also have rights and responsibilities under the law. For example:

  • Rent must be paid on time, and the property must be kept reasonably clean and undamaged.

  • Tenants must report maintenance issues promptly.

  • If you believe your rights are being breached, you can apply to the Tenancy Tribunal.

At Ray White Orewa, we pride ourselves on clear, fair communication and supporting tenants throughout their tenancy. We’re here to ensure that renting is a smooth and respectful experience for all parties.
